It is very important question and it will clarify important points, what you are taking about is what called “Claim Entitlement.” After you find events, Collect supporting document to record the EOT and also Analyse the impact of your EOT as duration with specified number of days, you have to think about “Claim Entitlement”
There are Tree main types of “Claim Entitlement”
1- Executable but non compensable usually due to events that happened out of contractor
and employer hand “Caused by Not Party” as examples below:
- Political Issues
- Strikes
- Fires, Floods, Epidemics
- Embargoes
- Wars
2- Executable and compensable usually due to the delays by the Employer or Client
“Caused by Client / Consultant” in this case you as a contractor have to take EOT and after that Extra Cost Claim. You can find below some of these delays reasons
- Late Material Submittal approvals
- Late equipment Submittal approvals
- Late shop drawing Submittal approvals
- Failure to commence Site Hand over
- Change request
- Payments delay
3- None Executable and None compensable usually due to the delays by the Contractor
“Caused by Contractor Delays” and in this case you don’t have any entitlement for EOT even Extra cost and this delays may be one of the following:
- Poor performance
- Poor coordination and planning
- Late performance by subcontractor
- Delay in procurement
- Defective work
